Long Covid Claims Put Exclusion Wording Under Pressure

Reported denials show why policy definitions matter when illness does not fit neatly into old categories

Reports of New Zealand income protection claims for Long Covid being declined under mental health exclusions have brought a difficult policy issue into public view: what happens when a disabling physical illness is assessed through wording originally designed for a different risk category?

Insurance Business NZ reported on 3 November 2026 that an insurance lawyer is preparing a possible group action to test the fairness and application of mental health exclusion clauses where policyholders are unable to work because of Long Covid. The issue had already been highlighted by Long Covid Support Aotearoa in an October 2026 statement, following reported cases where past diagnoses such as ADHD, anxiety or depression were linked to exclusions that insurers later relied on when assessing claims.

The central concern is not simply whether Long Covid is covered. It is how broadly an exclusion can operate. Some policy wordings may include sub-categories such as fatigue-related disorders within a mental health exclusion. For a customer who believed their cover protected them against illness-related loss of earnings, that distinction can be highly consequential, especially where medical evidence frames Long Covid as a post-viral condition affecting capacity, stamina and day-to-day functioning.

This is also a conduct issue. The Conduct of Financial Institutions regime has been fully in force since 31 March 2025, requiring licensed insurers to operate fair conduct programmes and treat consumers fairly across the product lifecycle, including claims handling. Whether any particular denial is correct will depend on the policy wording, underwriting history and medical evidence, but the wider debate shows why exclusions need to be clear at application time and consistently explained when claims are assessed.

For people reviewing income protection policy features, the practical lesson is to look beyond the monthly benefit amount. Waiting periods, benefit periods and claim definitions matter, but so do exclusions added after medical disclosure. A broad exclusion may affect more than the condition that originally prompted it, particularly if the wording captures related symptoms, syndromes or diagnostic labels.

Policyholders dealing with a complex illness may wish to keep careful records of policy schedules, underwriting correspondence, medical reports, occupational capacity evidence and insurer reasons for any claim decision. If a decision is disputed, the internal complaints process and external dispute resolution options may be relevant. Recent concern about insurance disputes shows that documentation and clear communication can materially affect how disagreements progress.

For advisers and insurers, Long Covid is a reminder that emerging health conditions can expose gaps between legacy wording and current medical understanding. For consumers, it reinforces a simpler point: the most important income protection questions are often found in the exclusions, not the headline benefit.
