Insurance Inquiry Delay Keeps Small Business Cover in Focus

Paige Estritori explains why personal trainers should watch the next phase of reform

Insurance Inquiry Delay Keeps Small Business Cover in Focus?w=400

A federal parliamentary inquiry into small business insurance has pushed its reporting timetable into early 2027, keeping affordability, availability and policy complexity on the agenda for sole traders, contractors and small operators across Australia.
For personal trainers, the delay does not change existing insurance obligations, but it does extend an important policy debate about whether current commercial cover is keeping pace with modern small business risks.

The inquiry has been examining the provision, regulation and pricing of insurance products for small businesses, not-for-profit groups and community organisations. Its focus areas include access to public liability, professional indemnity, cyber and business interruption insurance, along with affordability in different regions and higher-risk sectors. Industry reporting says the committee had received more than 100 submissions and held hearings in several capital cities before extending the date for its final recommendations.

Fitness businesses may not always be named in broad insurance reform debates, but they sit squarely within the issues being considered. A trainer can be exposed to injury allegations, property damage claims, venue contract requirements, equipment losses, data privacy concerns and income disruption if a studio, gym or outdoor location becomes unavailable. Many trainers also work across several settings, which can make policy wording, exclusions and limits more important than the label on the policy.

The practical message is not to wait for reform before reviewing basic risk information. Trainers can use the months before the report to February 2027 to make sure their business records accurately describe how they work, including:

  • whether sessions are delivered in gyms, parks, client homes, rented rooms, studios or online;
  • whether group classes, high-intensity formats, rehabilitation-style programmes or nutrition guidance are offered;
  • what insurance limits are required by venues, councils, landlords or corporate clients;
  • whether subcontractors, employees or guest instructors are used; and
  • how client health information, payment details and waiver records are stored.

That record-keeping matters because insurance disputes often turn on details: what was disclosed, what activities were insured, which entity was named on the policy and whether the claim falls within the wording. For trainers giving programming advice, exercise instruction or progress plans, professional indemnity considerations may sit alongside public-facing liability risks.

The inquiry may eventually recommend regulatory or market changes, but its extension also signals the complexity of the problem. Premium pressure, claims costs, contract demands, regional conditions and insurer risk appetite do not have one simple fix. In the meantime, personal trainers can treat the debate as a prompt to review cover limits, exclusions and business practices against the way they actually train clients today, rather than how the business looked at its last renewal.

Australian restaurants and cafes may be entering a more competitive phase for liability insurance, but the latest market analysis suggests owners should avoid treating softer pricing as a signal that risk has reduced. Australian trade businesses heading into renewal season may find the commercial insurance market more competitive than it has been for several years, with recent industry updates pointing to softer pricing across several business insurance classes.
